1. About Tingli

Tingli (ABN 33 142 698 602) is an Australian-based tipping platform that allows fans to send monetary tips and messages directly to ASMR creators. Tingli acts as a technology provider only. Payments are processed by Stripe and transferred directly to creators' Stripe accounts. Tingli does not hold, receive, or transmit funds on behalf of any party.

These terms are governed by the laws of Australia. By using Tingli, you submit to the non-exclusive jurisdiction of the Australian courts.

2. Eligibility & Age Requirement

Tingli is strictly for users aged 18 and over. This applies to all users, including creators receiving tips and fans sending them. By registering an account, completing a payment, or otherwise using any part of the Tingli platform, you confirm that you are at least 18 years of age and have the legal capacity to enter into a binding agreement under Australian law. Tingli reserves the right to immediately terminate any account where we have reason to believe the account holder is under 18.

If you are using Tingli on behalf of a business, you confirm you are authorised to bind that business to these terms.

3. Creator Accounts

Creators must connect a Stripe account to receive tips. By connecting Stripe, you agree to Stripe's Connected Account Agreement. You are solely responsible for the accuracy of your profile information and for meeting all applicable Australian tax obligations (including declaring income to the ATO) on amounts received through Tingli.

4. Tips, Messages, and Payments

Tips and message fees are voluntary payments from fans to creators. Tingli charges a platform fee of 5% on each transaction. All payments are final. Subject to your rights under the Australian Consumer Law (ACL), tips are non-refundable. Payment processing is handled by Stripe. By completing a payment, you agree to Stripe's Terms of Service.

5. Fan Messages

Fans may send a short written message with their tip for an additional fee. Messages must be used solely to show encouragement and support. Messages must not contain offensive, threatening, harassing, or defamatory content. Tingli reserves the right to remove messages that violate this policy and to suspend accounts that misuse the messaging feature.

6. Prohibited Conduct

You must not use Tingli to:

• Engage in fraud, money laundering, or any activity that breaches Australian law
• Misrepresent your identity or creator credentials
• Circumvent, disable, or interfere with security features of the platform
• Use automated tools to access or scrape the platform without consent
• Engage in conduct that would constitute a breach of the Australian Consumer Law

Tingli reserves the right to suspend or terminate accounts that violate these terms, without liability.

7. Australian Consumer Law

Nothing in these terms is intended to exclude, restrict, or modify rights you may have under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010 (Cth)) or any other applicable Australian legislation. If you are a consumer under the ACL, you have guarantees that cannot be excluded. Where permitted, Tingli limits its liability to re-supplying the relevant service or paying the cost of having the service re-supplied.

8. Intellectual Property

Creators retain full ownership of their content and likeness. By creating a profile on Tingli, you grant us a limited, non-exclusive, royalty-free licence to display your profile information (name, username, bio, avatar, social links) on the platform for the purpose of operating the service.

9. Limitation of Liability

To the fullest extent permitted by Australian law, Tingli is not liable for any indirect, incidental, special, or consequential loss or damage (including loss of revenue, loss of profits, or loss of data) arising from your use of the platform. Tingli does not guarantee uninterrupted access to the service or the conduct of any creator or fan.

10. Privacy

Your personal information is handled in accordance with our Privacy Policy and the Privacy Act 1988 (Cth). By using Tingli, you consent to the collection and use of your information as described in that policy.

11. Changes to These Terms

We may update these terms from time to time. We will provide reasonable notice of material changes by updating the date at the top of this page. Continued use of Tingli after changes are posted constitutes your acceptance of the revised terms.
